Rajasthan BJP MLA Kanwarlal Meena Faces Disqualification After High Court Upholds Jail Sentence

Jaipur: The political future of BJP MLA Kanwarlal Meena from Anta constituency in Rajasthan hangs in the balance after the Rajasthan High Court upheld a three-year jail sentence awarded to him by a lower court in a nearly two-decade-old case.

The ruling may lead to Meena’s disqualification under the Representation of the People Act, 1951, which mandates the removal of any elected representative sentenced to more than two years in prison.

The case stems from a 2005 incident during a repoll for a deputy sarpanch election in Aklera, Jhalawar. Meena was accused of brandishing a pistol at the Sub-Divisional Magistrate (SDM), obstructing government work, intimidating officials, and damaging public property.

On December 14, 2020, the Additional District and Sessions (ADJ) Court in Aklera found him guilty and sentenced him to three years in prison. Meena appealed the verdict, but the Rajasthan High Court rejected his plea and upheld the original conviction.

In its scathing remarks, the High Court stated, “At the time of the incident, the petitioner had identified himself as a political figure. Therefore, it was expected of him to cooperate in maintaining law and order rather than challenging it.”
