RG Kar Rape-Murder Case: CBI Opposes West Bengal Government’s Plea for Death Penalty to Convict

Kolkata: The Central Bureau of Investigation (CBI) on Wednesday opposed the West Bengal government’s plea for a death sentence for Sanjay Roy, the convict in the RG Kar rape and murder case. The CBI argued that the Mamata Banerjee-led state government was not a party to the case and therefore could not file such an appeal.

The case, which involved the rape and murder of a post-graduate trainee (PGT) doctor at RG Kar Medical College and Hospital on August 9, had resulted in a life imprisonment verdict for Roy by the Additional District and Sessions Court in Kolkata’s Sealdah on January 20. The court ruled that the case did not fall under the “rarest of the rare” category, which would warrant the death penalty.

During the hearing, Deputy Solicitor General Rajdeep Majumdar, representing the CBI, contended that only the victim’s family or the investigating agency could appeal the sentence. He questioned the state government’s jurisdiction to make such a plea in the Calcutta High Court.

The West Bengal government had approached the division bench of the High Court on January 21, challenging the special court’s decision. The admissibility of the state government’s petition will be determined in a hearing scheduled for January 27.

In its January 20 judgment, the Sealdah court not only sentenced Roy to life imprisonment until death but also directed the state to pay a compensation of ₹17 lakh to the victim’s family. Additionally, Roy was fined ₹50,000.

The CBI’s opposition has added a new dimension to the high-profile case, which has drawn widespread attention due to its gruesome nature and the involvement of a medical professional as the victim. The legal battle over the appropriate punishment for Roy is expected to continue in the coming weeks.
