Pawan Khera Approaches Gauhati High Court for Anticipatory Bail in Assam Case Over Allegations Against CM’s Wife

Pawan Khera Seeks Relief from Gauhati High Court

Congress leader Pawan Khera has moved the Gauhati High Court seeking anticipatory bail in a criminal case registered against him by the Crime Branch of Assam Police over allegations he made against Assam Chief Minister Himanta Biswa Sarma’s wife, Riniki Bhuyan Sharma.

The anticipatory bail plea was registered by the High Court registry and is expected to be listed before a bench for hearing. The case against Khera includes serious allegations such as defamation, forgery, and criminal conspiracy, escalating the legal and political battle surrounding his recent remarks.

The move comes after the Supreme Court stayed an earlier transit anticipatory bail order granted to Khera by the Telangana High Court.

Case Filed Over Remarks on CM’s Wife

The case against Pawan Khera was filed after he publicly alleged that Riniki Bhuyan Sharma, wife of Assam Chief Minister Himanta Biswa Sarma, holds multiple foreign passports and has undisclosed overseas assets.

During a press conference on April 5, Khera claimed that the Assam Chief Minister’s wife possessed passports from three different countries and owned luxury properties in Dubai, allegedly linked to a company registered in a US state.

These allegations led to a criminal complaint being lodged against the Congress leader, accusing him of making defamatory and fabricated claims.

Telangana High Court Had Granted Transit Bail

Earlier, on April 10, the Telangana High Court granted Pawan Khera one week’s transit anticipatory bail, allowing him time to approach the appropriate court in Assam for regular anticipatory bail.

Khera had filed the transit bail plea in Hyderabad, citing that he maintains a residence there.

However, the relief was short-lived as the Assam Police challenged the Telangana High Court’s order in the Supreme Court, arguing against the grant of transit protection.

Supreme Court Stayed Telangana HC Order

On April 15, the Supreme Court stayed the Telangana High Court’s order granting transit anticipatory bail to Pawan Khera.

The apex court, however, clarified that if Khera seeks anticipatory bail before the competent court in Assam, the Supreme Court’s interim stay would not affect the independent consideration of that bail application.

The Supreme Court said the Assam court should decide the anticipatory bail plea “independently, based on the material on record and on its own merits.”

This observation gave Khera the legal opening to approach the Gauhati High Court for relief.

Legal Battle Intensifies in Politically Sensitive Case

The case has become politically significant because it involves allegations made by a senior Congress leader against the family of a BJP chief minister.

The accusations regarding foreign passports and overseas assets have triggered a direct confrontation between the Congress and Assam’s BJP leadership, with the legal proceedings now moving to the Gauhati High Court.

With allegations of defamation, forgery, and conspiracy now formally on record, the High Court’s decision on anticipatory bail will be closely watched, both legally and politically.
