Odisha Congress Suspends 3 MLAs for Cross-Voting in Rajya Sabha Poll, Seeks Disqualification Under Anti-Defection Law

In a major political crackdown, the Indian National Congress in Odisha has suspended three of its MLAs for allegedly cross-voting in the Rajya Sabha elections and backing BJP-supported independent candidate Dilip Ray.

The suspended MLAs — Ramesh Chandra Jena, Dasarathi Gomango, and Sofia Firdous — are accused of defying the party whip during Monday’s voting, which played a crucial role in Ray’s unexpected victory.

Who Are the MLAs Suspended for Cross-Voting and What Happens Next?

The Congress leadership acted swiftly after confirming that the three MLAs voted against the official party line. Their suspension marks a strong disciplinary move and signals zero tolerance for internal rebellion.

The party has also initiated further action by pushing for their disqualification, which could lead to them losing their Assembly membership if the Speaker rules against them.

Can the Anti-Defection Law Apply in Rajya Sabha Cross-Voting Cases?

Senior Congress leader Ramachandra Kadam has formally written to the Assembly Speaker seeking action under the Anti-Defection Law.

The complaint states that despite a clear party whip, the MLAs engaged in cross-voting, violating provisions of the Tenth Schedule of the Constitution.

However, legal experts often debate whether the Anti-Defection Law fully applies in Rajya Sabha elections, as voting is conducted through an open ballot system where party whips do play a role—but enforcement can still become a matter of interpretation in specific cases.

The Congress has urged the Speaker to act swiftly, arguing that such actions undermine both party discipline and the mandate of the voters.

Leadership Calls It ‘Betrayal’, Warns of Strict Action

Odisha Congress president Bhakta Charan Das reacted strongly, calling the cross-voting a “betrayal.”

“Those who betray Congress are betraying the nation,” the party said in an official statement.

Das added that the central leadership has been informed and the party will ensure strict action, including disqualification proceedings against the MLAs.

How Did Cross-Voting Impact the Odisha Rajya Sabha Election Result?

The controversy has shaken opposition unity in Odisha, especially after reports that some Biju Janata Dal MLAs also cross-voted in favour of Dilip Ray.

This unexpected shift led to the defeat of the joint opposition candidate Datteswar Hota.

Out of four Rajya Sabha seats in Odisha:

  • Bharatiya Janata Party won two seats
  • BJD secured one seat
  • Dilip Ray clinched the fourth seat with surprise support

The episode has exposed cracks within opposition ranks and is expected to have major political repercussions in Odisha ahead of upcoming elections.
