BJP MP Nishikant Dubey Accuses Supreme Court of Overreach, Alleges ‘Inciting Religious Wars’

New Delhi: BJP leader and Lok Sabha MP Nishikant Dubey stirred controversy on Saturday by launching a scathing attack on the Supreme Court of India, alleging that the judiciary has been overstepping its constitutional limits and inciting religious tensions in the country. His remarks have triggered widespread political and legal debate.

Addressing the media, Dubey expressed strong disapproval of what he termed the “judicial overreach” of the apex court. He questioned the Supreme Court’s authority in lawmaking, asserting that such powers rest solely with Parliament. “If everything has to be decided by the Supreme Court, then why have a Parliament or State Assemblies?” he said, adding that the top court is behaving with bias and selective interpretation of laws.

Taking direct aim at Chief Justice of India Sanjiv Khanna, the BJP MP alleged that the CJI bore responsibility for what he described as civil unrest in the country. Dubey criticized past judgments, including the decriminalization of homosexuality, saying the decision went against traditional beliefs of various Indian religions. He also expressed dissatisfaction with the Supreme Court’s handling of matters related to religious sites like Ram Mandir, Krishna Janmabhoomi, and Gyanvapi.

Dubey further claimed that the Supreme Court was dictating terms to constitutional authorities such as the President and Governors regarding the passage of Bills—an area, he insisted, that falls under the legislative domain. “In which law is it written that the President must act within three months? The court cannot impose deadlines on the executive,” he said.

The BJP MP’s statements come amid an ongoing national conversation on the separation of powers between the judiciary and the legislature. While his comments have resonated with some in the political right wing, legal experts and opposition leaders have criticized the remarks as an attack on the independence of the judiciary.
