The Supreme Court on Wednesday raised concerns over the prolonged incarceration of former West Bengal minister Partha Chatterjee, who has been in jail for over two years in connection with alleged irregularities in academic staff recruitment. The court also scrutinized the Enforcement Directorate’s (ED) low conviction rates in money laundering cases, questioning the effectiveness of the central agency’s investigations.
A bench comprising Justices Surya Kant and Ujjal Bhuyan expressed unease about the delay in Chatterjee’s trial. “What will happen if we don’t grant bail? The trial is yet to commence, there are 183 witnesses in the cases. The trial will take time. How long can we keep him? That is the question,” the bench remarked to additional solicitor general S.V. Raju, who represented the ED.
The court underscored that the principle of justice includes the right to a fair and timely trial. Given the substantial number of witnesses and the current pace of proceedings, the bench indicated that a lengthy trial could unduly extend Chatterjee’s incarceration without resolution.
The ED arrested Chatterjee in July 2022 in connection with an alleged money laundering case linked to irregularities in the recruitment of academic staff under the West Bengal School Service Commission. The case also involved alleged disproportionate assets, with several crores of rupees in cash and assets seized during the investigation.
While the ED argued that Chatterjee’s release could hinder the investigation, the court pressed the agency to justify the prolonged pre-trial detention. The bench further asked about the ED’s low conviction rate, which has often been criticized as a weak link in the agency’s credibility.
The court has yet to make a final decision on Chatterjee’s bail plea, but its pointed questions suggest a broader concern about the balance between investigative prerogatives and individual rights. The next hearing in the case is expected to further address these critical issues.
