Will block access to AIMIM supporter if govt so orders: Facebook, YouTube tells Bombay HC

Social media platforms Facebook and YouTube yesterday told the Bombay High Court that they would block access of their websites to an AIMIM supporter, accused of posting inflammatory content aimed at creating communal unrest, if the Union Government or the court orders. A Division Bench of Chief Justice Dipankar Datta and Justice Madhav Jamdar was hearing a petition filed by Mumbai resident Imran Khan, seeking a direction to police to take action against Abu Faizal for uploading incriminating hate speeches on social media.

The petitioner’s lawyer earlier said, Faizal was a supporter of the Asaduddin Owaisi-led All India Majlis-e- Ittehad-ul-Muslimeen (AIMIM). The plea sought deletion of videos uploaded by Faizal and also a permanent ban to be imposed on him from all social media websites. The bench sought to know from petitioner’s advocate, Vivek Shukla, if the petitioner approached the Nodal Officer appointed by the government under the IT Act Section 69(A) (power to /block objectionable content posted online).

Chief Justice Datta said the IT Act has laid down a procedure by which any person can approach the Nodal Officer if he or she has a complaint against any content posted on the internet. He said, why should the court interfere and pass orders. The bench reserved its order on the plea.
