Waqf Amendment Unconstitutional, Must Be Struck Down: NAPM

New Delhi: The National Alliance of People’s Movements (NAPM) has strongly opposed the Waqf (Amendment) Act, 2025, terming it unconstitutional and discriminatory, and demanded its immediate repeal. The Act, passed in April with support from JD(U) and TDP, has already been challenged in the Supreme Court.

Despite the matter being sub judice, the Union Government notified the Unified Waqf Management, Empowerment, Efficiency and Development Rules (UMEED), 2025 in July. NAPM said this move reflects the government’s intent to consolidate control over waqf properties and disenfranchise the Muslim community.

According to NAPM, the amendment introduces several problematic changes. District Collectors have been empowered to decide if disputed property is waqf or state land, creating a conflict of interest. The provision of ‘waqf by user’, which recognised properties used for religious or charitable purposes over generations, has been abolished. Nearly 4 lakh such properties now face legal uncertainty. The composition of Waqf Boards has been altered by mandating the inclusion of non-Muslim members, which is seen as direct interference. In addition, the Act restricts donations by allowing only Muslims who have practised Islam for at least five years to dedicate property, excluding non-Muslims and recent converts.

NAPM argued that these changes undermine India’s plural traditions and weaken constitutional protections for minorities under Article 14. It said the law is part of a larger pattern of majoritarian measures such as the Citizenship Amendment Act, anti-conversion laws, bulldozer actions and the Uniform Civil Code in Uttarakhand, all aimed at politically and economically marginalising Muslims.

Calling for urgent action, NAPM urged the Supreme Court to strike down the law as ultra vires and appealed to democratic forces to unite against communal policies. “The Waqf Amendment Act must be repealed. We will resist all attempts to divide India and disenfranchise minorities,” the statement said.
