Supreme Court Stays Delhi High Court Order in Mahua Moitra Cash-for-Query Case, Issues Notices to Moitra CBI and Dubey

India’s Supreme Court on Friday intervened in the high-profile “cash-for-query” case involving Trinamool Congress leader Mahua Moitra, temporarily staying a key part of a previous judgment by the Delhi High Court. The decision came after the anti-corruption body Lokpal of India challenged the High Court’s earlier order regarding sanction for investigation by the Central Bureau of Investigation (CBI).

The case has attracted major political attention because it concerns allegations that Moitra asked questions in Parliament in exchange for money and gifts from a businessman. The Supreme Court’s latest move does not decide the case but pauses a part of the High Court ruling while the matter is examined further.

Supreme Court Issues Notices

A bench led by Chief Justice of India Surya Kant and Justice Joymalya Bagchi issued notices to several parties involved in the case. These include Mahua Moitra, the CBI and BJP MP Nishikant Dubey, who originally filed the complaint that triggered the investigation.

The Supreme Court was hearing a petition filed by the Lokpal challenging the High Court order. After hearing initial arguments, the bench decided to stay a specific paragraph of the High Court judgment that directed the Lokpal to reconsider granting sanction to the CBI.

By staying this portion of the ruling, the Supreme Court has temporarily stopped the process ordered by the High Court until the matter is fully examined.

What the Delhi High Court Had Ordered

On December 19, 2025, the Delhi High Court had set aside an earlier decision by the Lokpal that allowed the CBI to file a chargesheet against Mahua Moitra.

In its judgment, the High Court asked the Lokpal to reconsider the issue of sanction under Section 20 of the Lokpal Act and make a fresh decision within one month. The court stated that the Lokpal must follow the legal procedures and interpretation outlined in the judgment while deciding whether the CBI should be allowed to proceed.

This direction became the key point of dispute. The Lokpal argued that the High Court had exceeded its authority by interfering with its decision-making process, prompting the anti-corruption body to approach the Supreme Court.

What Is the Cash-for-Query Case?

The controversy revolves around allegations that Mahua Moitra asked questions in the Lok Sabha on behalf of a businessman in return for money and expensive gifts.

In Parliament, MPs have the power to ask questions to the government on various issues. These questions are an important part of democratic oversight because they force the government to provide explanations and information. However, if an MP asks questions in exchange for personal benefits, it is considered a serious breach of parliamentary ethics and corruption laws.

The complaint in this case was filed by BJP MP Nishikant Dubey, who accused Moitra of misusing her parliamentary position. Following the complaint, the Lokpal conducted a preliminary inquiry and later granted permission to the CBI to file a chargesheet against her.

Moitra challenged that decision in the Delhi High Court, arguing that the process followed by the Lokpal was legally flawed. The High Court accepted parts of her argument and set aside the Lokpal’s sanction order, which led to the latest legal battle in the Supreme Court.

What Happens Next

With the Supreme Court now stepping in, the legal process will continue at the highest level. The court has asked all parties to respond to the Lokpal’s appeal and will examine how Section 20 of the Lokpal Act should be applied in such cases.

For now, the stay order means that the earlier High Court directive to reconsider sanction cannot be implemented. The final outcome will depend on how the Supreme Court interprets the powers of the Lokpal and the procedures for allowing the CBI to prosecute public officials.

The case is being closely watched because it involves issues of parliamentary ethics, corruption investigations and the legal powers of India’s anti-corruption watchdog.
