Supreme Court Declines Stay on Appointment of Election Commissioners Ahead of Elections, Warns of Chaos

In a significant development just weeks before the upcoming elections, the Supreme Court has once again declined to order a stay on the law pertaining to the appointment of election commissioners, asserting that doing so at this juncture would only lead to “creating chaos.”

During a hearing on Thursday, the court emphasized that there were no allegations against the newly appointed election commissioners, Gyanesh Kumar and Sukhbir Singh Sandhu, who were chosen following modifications to the selection panel under the new legislation.

The bench comprising Justices Sanjiv Khanna and Dipankar Datta remarked, “You can’t say the Election Commission is under the thumb of the Executive.” The court pointed out to the petitioners that it could not presume the new law enacted by the Centre to be erroneous. Additionally, it stressed the importance of considering the balance of convenience, especially with elections looming.

The Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service, and Term of Office) Bill, 2023, was passed by Parliament last year and subsequently received the President’s assent.

Under the new law, the composition of the committee tasked with selecting election commissioners was altered, replacing the Chief Justice of India with a Union Cabinet minister. The committee now comprises the Prime Minister, a Union Cabinet minister, and the Leader of the Opposition, sparking concerns regarding its impartiality.

Following the selection of Gyanesh Kumar and Sukhbir Singh Sandhu by the panel last week, Adhir Ranjan Chowdhury, the Congress leader in the Lok Sabha, alleged that he had received 212 names for scrutiny the night before the meeting and was provided a shortlist of six names just before the session.
