School fees shall not be waived off during lockdown, says Rajasthan High Court

The Rajasthan High Court has said that the school fees during the lockdown period will not be waived off.

The Court on Thursday refused to order the waiving of fees. However, the bench also made it clear that if a parent is unable to deposit the fee on time, then the school cannot strike off the child’s name from the school list under any circumstances.

The court said this during a hearing on the plea filed by one advocate Rajeev Bhushan Bansal.

The division bench of the High Court comprising Justice Sabina and Justice Chandra Kumar Songara disposed of the PIL after conducting a hearing.

Bansal in his PIL said that due to the lockdown, parents are unable to pay school fee as the businesses are shut and people are undergoing financial crisis. As private schools are non-operational, the court should put a check on the fee collections by the schools.

Additional Advocate General (AAG) of Rajasthan Ganesh Meena said that the State on April 9 this year has already made a policy decision deferring the due payment of private schools fee, as on March 15, 2020 for three months.

Also, it was notified that none of the students name can be struck off the list on account of non-payment of fee, he further submitted.

The Court while keeping in view the submissions made by the AAG ruled that there is no ground for further interference by the Court at this stage and the petition hence stands disposed of accordingly.-IANS News
