New Delhi: In a notable development, the Delhi High Court on Monday criticized the Delhi Government for delaying the handling of Comptroller and Auditor General (CAG) reports. The court expressed strong disapproval, stating, “The way you have dragged your feet raises doubts about your bona fides.”
Justice Sachin Datta, heading the bench, questioned the government’s approach, emphasizing that the reports should have been promptly forwarded to the Speaker and debated in the Assembly. “The timeline is clear; you’ve delayed actions to avoid holding a session,” the bench remarked, adding that the delay in forwarding the reports to the Lieutenant Governor (LG) further raised questions about the government’s intentions.
The Delhi Government responded by arguing that with elections approaching, conducting sessions would be challenging. However, the High Court countered that such delays undermine the accountability of governance.
The matter arose from a petition filed by seven BJP MLAs demanding the tabling of 14 CAG reports in the Assembly. The petitioners argued that withholding the reports deprives legislators of their right to debate and ensure transparency in governance. Advocate Vijender Gupta, representing the BJP MLAs, urged the court to direct the Speaker to convene a special session, asserting that the reports are critical for holding the government accountable before the current Assembly’s tenure ends in February.
The Delhi Assembly Secretariat earlier informed the court that presenting the CAG reports at this stage would be futile, given the Assembly’s impending dissolution. However, the High Court emphasized the importance of transparency and accountability, deferring its final decision to a detailed hearing scheduled later in the day.
