Bombay HC Dismisses Seclink Technologies’ Plea, Adani Realty’s Rs 5,069 Crore Bid for Dharavi Redevelopment Project Stands

Mumbai: In a significant ruling, the Bombay High Court on Friday dismissed a petition filed by UAE-based Seclink Technologies Corporation, challenging the Maharashtra government’s decision to award the Dharavi Redevelopment Project to Adani Realty. The court’s bench, led by Chief Justice DK Upadhyaya and Justice Amit Borkar, rejected the plea, stating, “For the aforesaid reasons, the petition is dismissed.”

The Dharavi Redevelopment Project, one of the largest urban renewal initiatives in India, spans 259 hectares and has been in the spotlight for several years. In 2022, the Adani Group emerged as the highest bidder for the project with an offer of Rs 5,069 crore. This bid was selected after a fresh tender process, which had replaced the previous tender that Seclink had won with a higher bid of Rs 7,200 crore.

Seclink Technologies, however, contested the government’s decision to cancel the original tender and issue a new one with revised conditions. The company argued that the Maharashtra government had acted arbitrarily by favoring the Adani Group, which had submitted a lower bid.

In response, the state government filed an affidavit explaining that the earlier tender was scrapped due to several unforeseen global factors, including the economic disruptions caused by the COVID-19 pandemic and the ongoing Russia-Ukraine war. These events had significantly altered the financial landscape between 2019, when the original tender was issued, and 2022, when the fresh tender was opened.

The government further stated that the conditions in the market in 2022 were “materially” different from those in 2019, making the decision to cancel the old tender a prudent one. The Maharashtra government emphasized that the cancellation was done in good faith, with legal advice, and was ultimately in the public interest.

Additionally, the affidavit noted that there was no contract signed between the government and Seclink, thereby giving the company no legal right to challenge the new tender. The state argued that the new bidding process was open to all eligible parties, including Seclink, who could have participated in the fresh round of submissions.

This ruling effectively solidifies the Maharashtra government’s decision to move forward with the Adani Group’s bid for the Dharavi redevelopment, a major project that aims to transform one of Asia’s largest slums into a modern, sustainable urban hub. The project is expected to provide much-needed infrastructure, housing, and facilities to the residents of Dharavi.

The dismissal of Seclink’s petition is seen as a significant victory for Adani Realty and the Maharashtra government, as it clears the path for the ambitious redevelopment plans to proceed. The project is set to bring long-term benefits to Mumbai, boosting both its economy and infrastructure.
