Delhi: The Delhi High Court on Tuesday granted bail to expelled BJP leader and Unnao rape case convict Kuldeep Singh Sengar, temporarily suspending his life imprisonment while his appeal against conviction remains under consideration.
A division bench of Justice Subramonium Prasad and Justice Harish Vaidyanathan Shankar allowed Sengar’s plea, observing that his sentence can remain suspended until the court reaches a final decision on his appeal filed against the 2019 conviction. The court ordered his release on a personal bond of ₹15 lakh along with three sureties of the same amount.
However, the relief comes with strict safeguards aimed at protecting the survivor. The court has barred Sengar from entering within a five-kilometre radius of the victim’s residence and explicitly warned him against making any contact or issuing threats to the survivor or her family. He has also been directed to stay within Delhi for the entire duration of the bail period.
The High Court made it clear that even a single violation of these conditions would result in immediate cancellation of bail, underlining the seriousness of the offence and the need to ensure the survivor’s safety.
The case dates back to 2017, when the survivor—then a minor—was abducted and sexually assaulted. Following nationwide outrage and concerns over influence and intimidation, the Supreme Court had shifted the trial and related proceedings from Uttar Pradesh to Delhi in 2019 to ensure a fair and speedy trial.
In December 2019, the trial court convicted Sengar and sentenced him to life imprisonment, also imposing a substantial fine. The High Court’s order does not overturn the conviction but only suspends the sentence until the appeal is decided.
Separately, Sengar has also challenged his conviction in another case linked to the custodial death of the survivor’s father, for which he was sentenced to ten years in prison. That appeal is still pending before the Delhi High Court.
