SC refuses to entertain Param Bir’s plea, directs him to move HC and make HM party

SC expresses displeasure over Govt not implementing its judgment on police reforms

Mumbai: In a major jolt to embattled Director General of Police, Home Guards (DG Home Guards) and former Mumbai Police Commissioner Param Bir Singh, the Supreme Court of India on Wednesday refused to entertain Singh’s petition seeking Central Bureau of Investigation (CBI) probe into alleged corrupt practices of Maharashtra Home Minister Anil Deshmukh. The apex court instead, asked Singh to make Deshmukh a party to his petition and move the Bombay High Court instead.

The apex court however did observe that the charges levelled against the Maharashtra Home Minister were serious, but directed Singh to approach the Bombay HC first. The SC court asked Mukul Rohatgi who was appearing for Singh as to why Deshmukh was not made party in the case.

The SC further observed that its judgment on police reforms had not been implemented by the government.

Singh later withdrew his plea from the Supreme Court and stated that he would move the HC. The apex court in its order granted Singh the liberty to approach the HC. Sources disclosed that Singh would be moving the Bombay HC today itself.

The former Mumbai police commissioner had approached the SC directly under Article 32 over his transfer posting as DG Home Guards. He further contended that Maharashtra Home Minister Anil Deshmukh had forced him to implicate Bharatiya Janata Party (BJP) leaders in various cases.

Singh had directly moved the SC under Article 32 of the Constitution citing that the Maharashtra government had already withdrawn the general consent given to the Central Bureau of Investigation (CBI) from probing cases in Maharashtra.

The former Mumbai police commissioner had moved the apex court challenging his transfer following the arrest of now suspended Crime Branch Intelligence Unit, Assistant Police Inspector Sachin Vaze in the Mansukh Hiren alleged murder case. Vaze is accused of using the car of deceased Mansukh Hiren in planting explosives outside the residence of industrialist Mukesh Ambani in south Mumbai.
