SC directs Fadnavis to face trust vote by 5 pm on November 27, blow to BJP?

In a major blow to Bharatiya Janata Party (BJP), the Supreme Court of India (SC) in an interim order on Tuesday directed Chief Minister Devendra Fadnavis to face the floor test in the legislative assembly on November 27 (Wednesday) by 5 pm. The apex court turned down the BJPs arguments of Governor having given time till November 30 for the floor test, that the floor test be conducted by the Speaker. However, the SC in its order turned down the BJPs plea and instead directed that the floor test be conducted by a Pro-tem Speaker, no secret ballot be used and video-graphing and live telecasting the entire proceedings.

As per the interim order of the SC, the Pro-tem Speaker will be appointed by the Governor Bhagat Singh Koshyari for conducting the trust vote. The pro-tem speaker will be short-listed from amongst the list of the members submitted to him by the legislature secretariat. Sources disclosed that like in the Karnataka trust vote case, the Governor can select anyone from the names recommended to him for the Pro-tem post. The incumbent BJP Speaker Haribhau Bagade will have no role to play in the entire proceedings.

Between 11 am to 5 pm the pro-tem speaker shall administer the oath of membership to the newly elected members of the 14th Legislative Assembly. Thereafter, the pro-tem speaker shall call for the trust vote, after a debate, voting will be held by open ballot and not by secret ballot as per SC interim order. The entire process will be video-graphed and telecast live and should be completed by 7 pm. Fadnavis now has about 30 hours to prove his government enjoys trust of the assembly.

Speaking to newspersons outside the SC court complex, senior Congress leader Prithviraj Chavan remarked that on the Constitution Day, the apex court has upheld the constitution. He demanded that Fadnavis should resign immediately. Senior Shiv Sena Lok Sabha MP Gajanan Kirtikar expressed satisfaction on the verdict. Senior advocate and Congress leader A M Singhvi stated that the BJP tried to form the government based on the letter that had no covering letter, no preface paragraph and no MLA had stated that they had supported Ajit Pawar decision to support BJP in government formation.

Congress president Sonia Gandhi expressed confidence that the Congress-NCP-Sena led Maha Vikas Aghadi shall win the trust vote. Reacting to the SC verdict, NCP president Sharad Pawar termed it as SC upholding the constitution on constitution day. Sena legislature party leader Eknath Shinde demanded that Fadnavis tender his resignation letter.

He stated that the Congress-NCP-Sena has submitted the list of 162 MLAs support letter and will prove the majority on the floor of the house. Speaking to newspersons, state BJP president Chandrakant Patil expressed confidence that the BJP will prove its trust vote. Meanwhile, the NCP is making all out efforts to woo Ajit Pawar back to party fold. On the other hand Ajit Pawar arrived at Chief Minister Devendra Fadnavis official residence Varsha to decide on the modalities of the trust vote.
