The Delhi High Court, in a significant development on Wednesday, refrained from granting any interim relief to Delhi Chief Minister Arvind Kejriwal, who is currently in the custody of the Enforcement Directorate (ED). The court issued notices regarding Kejriwal’s plea and scheduled the matter for further hearing on April 3.
A bench of Justice Swarana Kanta Sharma directed the ED to respond to Arvind Kejriwal’s plea seeking immediate release and challenging the legality of his arrest and remand. The agency has been instructed to submit its reply by April 2.
Senior advocate AM Singhvi, representing Kejriwal, contended that no response from the ED was necessary. However, the court emphasized its duty to ensure fair proceedings by hearing both sides, stating that the ED’s response is crucial to decide the case.
In its ruling, the court underscored the importance of providing an opportunity for effective representation, as per the principles of natural justice. Failure to grant this opportunity would constitute a denial of fair hearing and violate the principle of audi alteram partem, applicable to both parties involved.
Meanwhile, the ED is expected to produce Kejriwal before a court on Thursday, as his current remand is set to expire. Kejriwal was arrested by the ED last Thursday in connection with the Delhi liquor probe, following which the agency sought a six-day custody starting from March 22. The ED may seek an extension of Kejriwal’s custodial remand or request court directions for his transfer to judicial custody.
Concerns have been raised about Kejriwal’s health during his custody, particularly as he is a diabetic patient. Sources revealed that his sugar levels have been fluctuating, dropping as low as 46 at one point, although the timing of this measurement was not disclosed.
