Calcutta High Court Declines Immediate Intervention in Assembly Leadership Dispute
The Calcutta High Court on Thursday refused to grant interim relief in the ongoing dispute over the post of Leader of the Opposition in the West Bengal Assembly, providing temporary relief to rebel legislator Ritabrata Banerjee.
With the court declining to interfere at this stage, the decision taken by Assembly Speaker Rathin Basu recognizing Ritabrata Banerjee as the Leader of the Opposition will remain effective until further proceedings.
Next Hearing Scheduled for July
Justice Krishna Rao fixed July 28 as the next date of hearing and instructed all parties involved in the matter to submit their affidavits before the case is taken up again.
In its observation, the court stated that it did not find sufficient grounds at this stage to issue an interim order suspending the Speaker’s decision.
Challenge Filed by Mamata Camp Loyalist
The legal challenge was initiated by senior Trinamool Congress MLA Shovandeb Chattopadhyay, who sought judicial intervention against the Speaker’s decision.
The petition questioned the process through which Ritabrata Banerjee was accepted as the Leader of the Opposition despite the party leadership backing Shovandeb Chattopadhyay for the role.
Political Rift Deepens Within Trinamool Congress
The dispute stems from a growing divide within the Trinamool Congress legislative unit following the Assembly election setback faced by the party.
While the party leadership had proposed Shovandeb Chattopadhyay to lead the opposition bench, a large section of legislators reportedly rallied behind Ritabrata Banerjee. Backed by the support of dozens of MLAs, Ritabrata emerged as the preferred choice of the rebel camp and was subsequently recognised by the Speaker.
The development highlighted the widening differences between the party leadership and a significant section of its legislators.
Court Raises Questions Over Speaker’s Actions
During earlier proceedings, the court examined the sequence of events surrounding the rival claims.
Questions were raised regarding why a representation submitted by the party leadership naming Shovandeb Chattopadhyay allegedly remained pending, while a later communication from the rebel group received prompt consideration.
The court also sought clarification on the apparent difference in treatment between the two representations, an issue that is expected to be examined further during subsequent hearings.
Ritabrata Continues as Opposition Leader for Now
For the moment, Ritabrata Banerjee’s position as Leader of the Opposition remains unchanged. The legal battle, however, is far from over, with the High Court set to revisit the matter next month as political tensions within the Trinamool Congress continue to attract attention across West Bengal.
