SC Rebukes UP Govt for Unlawful Detention Over Bail Technicality; Orders Rs 5 Lakh Compensation, Demands Jail Officials Be Held Accountable

New Delhi: In a strong rebuke to Uttar Pradesh authorities, the Supreme Court on Wednesday directed the state government to pay a provisional compensation of ₹5 lakh to a man who remained in jail despite being granted bail, due to what the court termed as a “useless” technicality.

The accused, Aftab, was granted bail by the apex court earlier in a case under the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act, 2021. However, jail authorities refused to release him, citing that Sub-section (1) of Section 5 was not explicitly mentioned in the bail order, causing a delay.

A Bench of Justices K.V. Viswanathan and N.K. Singh expressed deep concern over the lapse, calling the incident “unfortunate” and ordered the Ghaziabad Principal District and Sessions Judge to conduct an enquiry. If any jail officer is found individually responsible, the court added, the compensation could be recovered from them personally.

Appearing virtually before the court, the Director General (DG) of Prisons, Uttar Pradesh, was told to ensure such delays do not recur. The court also directed him to sensitise all jail officials across districts to follow judicial orders and uphold the liberty of individuals.

The court stressed that no person should remain in jail due to “avoidable administrative delays.” It further summoned the Superintendent of Ghaziabad District Jail and ordered him to appear in person, while the DG (Prisons) joined the hearing via video conferencing.

The matter will now be heard again on August 18, when the court will also review the findings of the enquiry.

The bail was originally granted on April 29, when the court observed that the accused’s marriage was performed as per Hindu customs and involved interfaith parents. The accused had been booked under Section 366 of the IPC and Sections 3 and 5 of the anti-conversion law.

Despite clear instructions from the court, the release order was returned by jail officials over mismatched details in their register, triggering the apex court’s intervention.

The Supreme Court has now asked the Uttar Pradesh government to pay the ₹5 lakh compensation by Friday and to treat the liberty of individuals with the seriousness it demands.
