Mumbai: Although a constitutional bench of the Supreme Court has ruled that the Election Commission of India (ECI) will decide the Shiv Sena party symbol, it will not benefit the Shinde faction much. Basically, the issue of eligibility of 16 MLAs including Eknath Shinde has not been resolved yet, the hanging sword of disqualification remains on them and the existing government in the state is unconstitutional, and until their eligibility is decided, they have no right to take any constitutional decision, remarked Maharashtra Pradesh Congress Committee (MPCC) chief spokesperson Atul Londhe. 

Commenting on the political situation in the state on Tuesday, Atul Londhe said that even though the Eknath Shinde group has passed the confidence motion in the Assembly, the most important point is that Eknath Shinde is also facing the pending disqualification petition.

Even though the decision of the party symbol is to be taken up the Election Commission of India, the Supreme Court must consider the situation before June 29, and in view of the fact, deputy speaker of the Assembly, Narhari Zirwal was in the chair and the court had given an extension to the order he had issued. The Shinde group formed their government while the court had extended the deadline.

So, by considering the situation before June 29 only the deputy speaker Narhari Zirwal could take the decision of disqualification. There is no reason to believe that the court’s decision is a big relief for the Shinde group. Uddhav Thackeray group will present evidence in the Election Commission and the Election Commission will decide who is the real Shiv Sena party and who can retain the party symbol.

But the issue of disqualification of MLAs and the issue of party symbol are two separate issues. According to the provisions of the anti-defection Act, the court will have to decide on the disqualification of 16 people including Eknath Shinde and after that the illegal, unconstitutional Shinde Fadnavis government will go in the state, Londhe said.
