New Delhi: A district court at Saket has declined to grant interim protection to a woman accused of filing multiple false rape and molestation cases in Delhi, while hearing a complaint alleging misuse of criminal law for extortion.
According to submissions made before the court, the woman has filed as many as 10 rape and molestation cases across Delhi, including a rape case against former Indian Army officer Captain Rakesh Walia. Advocate Bharat Chugh, appearing for the complainant, informed the court that Captain Walia, a cancer survivor, was allegedly threatened and asked to pay ₹2 lakh to settle the case.
The rape case filed against Captain Walia was subsequently quashed by the Supreme Court of India in February 2025, with the apex court observing that the proceedings amounted to an abuse of the process of law.
Following the Supreme Court order, an FIR was registered against the woman in March 2025. The investigation was later transferred to the Delhi Police Crime Branch in June 2025 on the directions of the Joint Commissioner of Police.
Previous Cases Cited Before Court
The court was further informed that in one molestation case filed by the woman, the matter was settled before the Delhi High Court within five months of registration of the FIR.
In another rape case, filed against a court reader attached to the Rouse Avenue Court, the accused was acquitted. In that judgment, the trial court reportedly observed that false implication could not be ruled out based on the evidence on record.
After hearing the submissions, the Saket District Court declined to grant interim protection to the woman at this stage. The matter is now listed for further hearing on February 27, 2026.
Captain Rakesh Walia is being assisted pro bono in the matter by the Ekam Nyaay Foundation, a non-governmental organisation providing legal support, which has been involved in the case for the past four years.
