New Delhi: The Supreme Court on Monday assumed control of all legal petitions filed across different High Courts that contest the constitutional validity of the recently enacted Promotion and Regulation of Online Gaming Act, 2025.
A bench comprising Justice J.B. Pardiwala and Justice K.V. Viswanathan directed that ongoing proceedings in the Delhi, Karnataka, and Madhya Pradesh High Courts be transferred to the apex court to prevent parallel litigation. “The proceedings from Karnataka, Delhi, and Madhya Pradesh High Courts stand transferred to this Court. The respective High Courts are directed to forward the complete case records, along with all pending applications, within one week,” the order read. The court also clarified that petitioners could refile their writs with complete records before the SC registry once the transfer is complete.
The Union government had sought the consolidation of these cases, noting that multiple petitions across states could lead to conflicting rulings. Last week, Chief Justice of India B.R. Gavai had agreed to list the transfer plea urgently, after being informed that the Karnataka High Court was set to pass interim orders in one of the challenges.
The Online Gaming Act 2025, introduced by Union Electronics and IT Minister Ashwini Vaishnaw during the Monsoon Session, bans all real-money games while encouraging esports, educational, and social gaming platforms. The law, passed in both Houses of Parliament within minutes, carries stringent punishments. Service providers face fines of up to ₹1 crore and imprisonment of up to three years, while those promoting or advertising money-gaming platforms risk penalties of ₹50 lakh and up to two years in jail.
Several gaming companies and digital platforms, including Dream11, Rummy Circle, PokerBazi, and others, have already suspended their real-money contests in compliance with the law. Petitioners challenging the Act argue that it imposes a blanket ban on judicially recognised “games of skill” and infringes on the right to trade and livelihood.
The Madhya Pradesh High Court recently sought the Centre’s reply on a plea citing violation of fundamental rights, while the Karnataka High Court had previously issued notice in a petition filed by Head Digital. An online carrom platform had also approached the Delhi High Court against the restrictions.
Prime Minister Narendra Modi, defending the new legislation, said it was essential to “safeguard families and society from the harmful effects of online money games.” He hailed the passage of the Bill, which cleared the Lok Sabha in just seven minutes and the Rajya Sabha in 26 minutes.
